Farah Dagogo vs INEC, Rivers REC: Court to give ruling on joinder, May 5th



The Federal High Court sitting in Port Harcourt has set aside May 5th, 2016 as the day  to give ruling on an application for joinder presented by the All Progressives Congress, APC, in the suit filed by the lawmaker elect for Degema Constituency in the Rivers State House of Assembly, Hon. Doctor Farah Dagogo against the Independent National Electoral Commission, INEC.

Farah Dagogo had dragged INEC, with its Rivers State Resident Electoral Commissioner, REC, Rivers State House of Assembly, its Speaker and Clerk as respondents to court over the continued failure of INEC to issue him Certificate of Return despite being duly declared winner of the March 19 legislative rerun election by INEC Returning Officer for Degema Local Government Area in full compliance with the electoral law.

The APC and its candidate in the election, Hon. Eldred Braide, however filed a separate application to be joined in the suit as a necessary party.

At the resumed hearing of the suit on Thursday( April 28), Justice Mohammed Lima said he will give his ruling on the twin application of joinder filed by the APC and its candidate on the aforementioned date.
