STILL ON THE VICTORIA NYECHE DEBACLE: DAME ALERUCHI COOKEY-GAM, YOU ARE WRONG
Much to my surprise, I read a treatise in reaction to the Hon. Victoria Wobo Nyeche’s non inclusion in the oath administration exercise of the Rivers State 8th Assembly on the 21st day of April 2016 by Dame Aleruchi Cookey-Gam, the erstwhile first female Attorney General and Commissioner for Justice, Rivers State (1999-2003); first female Secretary to the Rivers State Government and pioneer Administrator, Greater Port Harcourt City Development Authority.
Ma, all due respect accorded to you, I beg to differ. Whilst you rightly defined impersonation as the act of pretending to be someone else with intent to defraud another, and went further to state that impersonation is a criminal offence under section 484 of our criminal code, you forgot to note also that if someone lays claim to hold or occupy an office or position he or she does not hold, that person is guilty of impersonation whether or not such position or office is reserved for him or her.
So you asked “can a person be said to impersonate herself?” and my answer is No and Yes! No because Mr. Peter for example cannot impersonate being Mr. Peter, but Mr. Peter can impersonate being Mr. Peter the owner of Port Harcourt International airport. Whereas he is Mr. Peter, he is not the owner of the airport he is laying claim to and so to that extent, he has impersonated and may I say that this is a no-brainer.
As to whether Hon. Victoria Nyeche impersonated or not is a matter before a competent court of jurisdiction so I will rather resist the temptation of dabbling into that discussion, as it will amount to subjudice. But I know as a matter of fact that until an elected legislator has duly sworn to the oaths of office and allegiance to the Constitution of Federal Republic of Nigeria, such legislator cannot partake on an official level or carry out any legislative or oversight functions of the House, as he or she is not an Honorable member of the house but a member-elect.
Ma, you were also interested in knowing Mr. Livingstone Wechie’s locus in this issue and if indeed Hon. Victoria carried out the act of impersonation how it affects or cause injury to him amongst others.
Well Ma, as much as I’m not interested in holding brief for Mr. Livingstone, I daresay that Mr. Livingstone is a free citizen of Nigeria, an indigene of Rivers State and one of the very active and vocal spokesperson of Civil Liberties Organization, and just like every one of us who sees what could be a misgiving, reserves the right for personal interest or in the interest of the public to seek redress in court, owing to the fact that whatever laws Hon. Victoria is going to make in the Assembly will directly or indirect affect him or the people whose interest he and his organization strives to protect.
As to the question whether the Police has carried out investigation; whether she has been found guilty of impersonation is neither here nor there as it wasn’t a Court Judgment that stopped the Assembly from administering the oath on her but a Court Order, the main suit is still pending. Whereas no body was sentenced, rather the court in it’s wisdom ordered all defendants / respondents to maintain status quo pending the hearing of a motion on notice for an order of Interlocutory Injunction brought before it by Livingstone.
You adjudged that RVHA was reduced to a 9 member house sometime in 2015 and as such could no longer seat as it had no quorum. You went further to question the legality of the same 9 member house screening and confirmation of the then Acting Chief Judge now Chief Judge of Rivers State, Hon. Justice Adanma Iyayi-Laminkara. Worthy of note is that Hon. Victoria Nyeche shares in this same sentiment, which ensued to the “impersonation letter” and Livingstone’s suit afterwards.
The question whether 9 can form quorum or not is subject to constitutional interpretation, however, assuming but not conceding that 9 can’t form quorum, on what terra firma then is Hon. Victoria Nyeche seeking to be sworn in? Is she saying that 9 cannot seat and screen the Chief Judge but 9 can seat and swear her in? Wouldn’t that also culminate to “legislative recklessness and violation of the provision of the constitutional provisions” as you alluded? She cannot approbate and probate at the same time.
Interestingly you asked and I quote, “Was Hon. Victoria Nyeche as a duly elected member of the House justified in formally notifying the Chief Justice of Nigeria of the acts of Legislative recklessness and violations of the constitutional provisions as to the lack of quorum and its consequences? Can this exercise of her rights as a duly elected member be said to have given rise to the so-called impersonation? End of quote.
I daresay that there is nothing wrong with the exercise of notifying appropriate authorities of a perceived misgiving. But the pertinent question we must ask ourselves and learn from is that, on what capacity was the petition from Hon. Victoria to the CJN written? Who did she write as? Did she write as member-elect or as a member? The message might be right, but what about the messenger or the vessel? It can’t always be a case of “it’s not the messenger but the message”; not when the messenger is deemed to have committed an act in breach of the Constitution or criminal code whilst passing the message. We do not celebrate but admonish a pregnant 15 years old unmarried girl child simply because pregnancy and indeed childbirth is a blessing.
I disagree in strong terms your assertion that Rivers State is lying prostate and bleeding, as it is diversionary and in dear contradiction to the realities on ground. The state is working and making remarkable and unprecedented progress amidst internal and external interference and economic challenges occasioned by the sharp and continues decline of Naira value and dwindling federal allocation to the state. Evident to this are the monumental up-spring of infrastructure and steady increase in the IGR of the state. Thanks to the doggedness and political will of Governor Nyesom Wike.
Ma, Hon. Victoria Nyeche is a politician; her election and the subsequent tribunal and appeal court processes and of cause Rulings are processes of the election and in turn politics. It’s all politics and so the question of “politicizing everything” shouldn’t have even arisen in the first place, as you cannot politicize what is already politics ab initio.
It is misleading and grossly unfair for anyone today to say that “governance is abandoned while energy is dissipated in needless controversies and political turmoil”. While in truth and reality what we see everyday and indeed everywhere in Rivers State are scores of infrastructural development ongoing and completed within the first one year of an administration faced with unending high and mighty internal and external forces of impediments. Forces so powerful that it can deploy at will an entire Army Barack to descend on innocent and unsuspecting citizens going about their legitimate businesses or trying to exercise their civic and constitutional responsibilities. Invading and destroying their homes and properties; kidnapping and killing their fathers, pregnant mothers and children.
Indeed the media and specially the new media space remains open and awash with all manner of propaganda, misinformation and distorted information by a greater number our political players and populace, I do hope and pray that the respected but paltry characters whose integrity are still not mutilated or redeemable do not give it all away on the alter of political patronage or in a bid to fanning the flames of a wildfire ego of their master.

Madam Martha, an old woman believed to be in her 80s has been robbed and raped by three unknown guys believed to be ‘area guys’ at her resident in New Akrofuom in the Ashanti Region.

Narrating her ordeal to Jackson Joe Nimako, the area’s Unit Committee Secretary, Martha said the three unknown guys broke into her room and assaulted her after she questioned them of their mission in her room.
She added that the three gave her slaps that made her lose consciousness. She gained consciousness, only to find the guys having sex with her in turns.
The three guys who raped her stole her belongings and left her in pain and bleeding profusely.
Jackson Joe Nimako disclosed that the victim has since received medical attention while the case has been reported to the police with no arrest made.

Farah Dagogo vs INEC, Rivers REC: Court to give ruling on joinder, May 5th
The Federal High Court sitting in Port Harcourt has set aside May 5th, 2016 as the day to give ruling on an application for joinder presented by the All Progressives Congress, APC, in the suit filed by the lawmaker elect for Degema Constituency in the Rivers State House of Assembly, Hon. Doctor Farah Dagogo against the Independent National Electoral Commission, INEC.
Farah Dagogo had dragged INEC, with its Rivers State Resident Electoral Commissioner, REC, Rivers State House of Assembly, its Speaker and Clerk as respondents to court over the continued failure of INEC to issue him Certificate of Return despite being duly declared winner of the March 19 legislative rerun election by INEC Returning Officer for Degema Local Government Area in full compliance with the electoral law.
The APC and its candidate in the election, Hon. Eldred Braide, however filed a separate application to be joined in the suit as a necessary party.
At the resumed hearing of the suit on Thursday( April 28), Justice Mohammed Lima said he will give his ruling on the twin application of joinder filed by the APC and its candidate on the aforementioned date.

I am here to share with you this vital information on Prostate. The topic is misleading. Is prostate strictly for men? Yes, ONLY men have prostate and ONLY men over 40years but the healthcare enlightenment is for everyone. There is no woman who does not know a man 40 years and above – father, uncle, brother, son, friend, neighbor, colleague …
Essentially what I will be doing today is health promotion. Responsible health promotion must provide three things:
1. Information
2. Reassurance
3. A plan of action.
Let me start with a background on prostate health.
Everyone has a pair of kidneys. The job of the kidney is to remove waste. It is the LAWMA (waste management company) of your body. Everyday your blood passes through the kidney several times to be filtered. As the blood is filtered, urine is formed and stored in a temporary storage tank called the urinary bladder.
If there were to be no urinary bladder, as a man walks on the road, urine will be dropping.
Now think of the plumbing work in your house. Think of the urinary bladder as the overhead storage tank. From the storage tank, a good plumber will run pipes to other parts of the house, including the kitchen. God in His wisdom ran pipes from our urinary bladder to the tip of the penis. The pipe is called the urethra. Just below the bladder and surrounding the urethra is a little organ called the prostate gland.
The prostate gland is the size of a walnut and weighs about 20grams. Its job is to make the seminal fluid which is stored in the seminal vesicle. During sexual intercourse, seminal fluid comes down the urethra and mixes with the sperms produced in the testicles to form the semen. So semen technically is not sperm. It is sperm + seminal fluid. The seminal fluid lubricates the sperm.
After age 40, for reasons that may be hormonal, the prostate gland begins to enlarge. From 20 grams it may grow to almost 100 grams. As it enlarges, it squeezes the urethra and the man begins to notice changes in the way he urinate.
If you have a son under 10, if he has a little mischief like we all did at that age, when he comes out to urinate, he can target the ceiling and the jet will hit target. Call his father to do same, wahala dey. His urine stream is weak, cannot travel a long distance and sometimes may come straight down on his legs. So he may need to stand in awkward position to urinate.
Not many men will be worried their urine stream cannot hit the ceiling. Toilets are on the floor and not on the ceiling. But other symptoms begin to show.
TERMINAL DRIPPLING:
The man begins to notice that after urinating and repacking, urine still drops on his pants. This is the reason why after an older man urinates, he has to ring bell. A younger man simply delivers to the last drop and walks away. Just see an older man coming from the bathroom. Sometimes he may clutch the newspaper closely to hide the urine stains, particularly on plain colored trousers.
HESITANCY
At this point you wait longer for the urine flow to start. There are 2 valves that must open for you to urinate – the internal and external sphincters. Both open but because of obstructions in the urethra, you wait long for the flow to start.
INCOMPLETE EMPTYING
You have this feeling immediately after urinating that there is still something left.
As all these things happen, the bladder begins to work harder to compensate for the obstruction in the urethra. The frequency of urination goes up. Urgency sets in. sometimes you have to practically run into the toilet. Nocturia also becomes common. You wake up more than 2 times at night to urinate. Your wife begins to complain.
Men being men may not talk to anyone even at this point. Then the more serious complications start.
Stored urine gets infected and there may be burning sensation when urinating.
Stored urine forms crystals. Crystals come together to form stone either in the bladder or in the kidney. Stones may block the urethra.
Chronic urinary retention sets in. The bladder stores more and more urine. The size of the bladder is 40 - 60 cl. A bottle of coke is 50cl. As the bladder stores more urine it can enlarge up to 300cl. An overfilled bladder may leak and this leads to wetting / urinary incontinence. Also the volume may put pressure on the kidney and may lead to kidney damage.
What may likely bring the man to hospital is acute urinary retention. He wakes up one day and he is not able to pass urine.
Everything I have described above is associated with prostate enlargement, technically called benign prostate hyperplasia.
There are other diseases of the prostate like:
1. Prostatitis – inflammation of the prostate
2. Prostate cancer – cancer of the prostate.
This discussion is on prostate enlargement.
I have bad news and good news.
The bad news is that everyman will have prostate enlargement if he lives long enough.
The good news is that there are life style changes that can help the man after 40 to maintain optimum prostate health.
Nutrition
Look at what you eat. 33% of all cancers, according to the US National Cancer Institute is related to what we eat.
Red meat everyday triples your chances of prostate disease. Milk everyday doubles your risk. Not taking fruits / vegetables daily quadruples your risk.
Tomatoes are very good for men. If that is the only thing your wife can present in the evening, eat it with joy. It has loads of lycopene. Lycopene is the most potent natural antioxidant.
Foods that are rich in zinc are also good for men. We recommend pumpkin seeds (ugbogulu).
Zinc is about the most essential element for male sexuality and fertility.
Men need more zinc than women. Every time a man ejaculates he loses 15mg of zinc. Zinc is also important for alcohol metabolism. Your liver needs zinc to metabolize alcohol.
ALCOHOL CONSUMPTION
As men begin to have urinary symptoms associated with prostate enlargement, it is important they look at alcohol consumption. More fluid in means more fluid out.
Drink less. Drink slowly.
EXERCISE
Exercise helps build the muscle tone. Every man should exercise. Men over 40 should avoid high impact exercise like jogging. It puts pressure on the knees. Cycling is bad news for the prostate. We recommend brisk walking.
SITTING
When we sit, two-third of our weight rests on the pelvic bones. Men who sit longer are more prone to prostate symptoms. Do not sit for long hours. Walk around as often as you can. Sit on comfortable chairs. We recommend a divided saddle chair if you must sit long hours.
DRESSING
Men should avoid tight underwear. It impacts circulation around the groin and heats it up a bit. While the physiological temperature is 37 degrees, the groin has an optimal temperature of about 33 degrees. Pant is a no - no for men. Wear boxers. Wear breathable clothing.
SMOKING
Avoid smoking. It affects blood vessels and impact circulation around the groin.
SEX
Regular sex is good for the prostate.
Celibates are more prone to prostate illness. While celibacy is a moral decision, it is not a biological adaptation. Your prostate gland is designed to empty its contents regularly.
Thought: You have a moral obligation to share it with others because someone in your friends list might be saved.

A brief update on how the uniport Faculty presidents' have gone in Correcting,resolving unrest b/w the school management and our unique students generally,,,thou I hv been briefin our department presidents,
I will start from Sunday 10th April,when the faculty prez,confirmed the signals that our students are tired of suffering(high school fees,no results after exam,no school fees no exam policy,in some faculties -peculiar charges)etc..and hv concluded on havin a peaceful Protest by Monday 11th April...the faculty president call the attention of the SUG,but the SUG didn't throw immediate support,...because faculty president couldn't stop students from protecting,we decided to support, manage and control the protest by seeing the presence of Media(Tv&radio)for students to air there grievances and what they wanted from school management.
Unfortunately as we no in the curse of the Protest one of our students from MANAGEMENT FACULTY cmrd peter faculty president of managment sciences,was shot dead,as a result of the inability of our Vc,=Prof lake,the school PRO=wordu,the school CSO=Reginald,and our own the dean students affairs=Dr otu. To management protest...
After the protest and the death of our Colleague cmrd Peter,the faculty president wrote a communique demanding as follows
1) the immediate resignation/ removal of the VC due to his regid policy and wicked decision not to change ground on NO SCHOOL FEES NO EXAM
2) The immediate resignation/ removal of the P.R.O for misinforming the general public and Nigerian students.
3) the immediate resignation/ removal of C.S.O for not being able to instruct,the police,army,SARS on the they should treat students.which lead to the men of police to shot and kill cmrd Peter.
4)the immediate resignation/ removal of the dean students affairs not standing with the students as a mediate during the protest
5)the removal of the policy NO SCHOOL FEES NO EXAM.
6) etc
It is worthy to note that after the protest the school management invited the national body of NANS(national association of Nigerian students)led by the v.p on special duties...this first set of NANS came not for the interest of uniport student s but to favour uniport management,after dia unfavorable decision the school gave the 3m....when the faculty presidents sensed what heard transpired,we lost faith on the NATIONAL BODY OF NANS,and decided to work with the ZONE B NANS...HONESTLY zone B NANS is speaking the interest of uniport student,we hv written to different bodies,national assembly,minister of education,NUC,TUC,UNIPOT GOVERNING COUNCIL,HUMANRIGHT..ETC

A Trap Has Been Laid For Ghana – Duncan-Williams
Archbishop Nicholas Duncan-Williams has said there is a trap laid for Ghana, in the maritime dispute with its western neighbour Ivory Coast.
“…That thing, I keep talking talking talking and people are not hearing; they’ll wait till somebody from another country prophesies, then they start running. That borderline dispute, there is something in it, and if we don’t pray, Ghana will be disadvantaged by the verdict that will come out if we don’t do something and find out who the lawyers representing Ghana are, and look into that thing. There is some trap in it. Watch it. You write it down,” the founder of Action Chapel International prophesied to his congregation on Sunday April 24.
To safeguard Ghana’s interest in the maritime borderline dispute, Archbishop Duncan-Williams said he has “summoned” some men of God, including Bishop Titi-Ofei, Bishop James Saah and Rev Robert Ampiah-Kwofie, among others, for 12-hour daily prayers starting May 2. “We want to pray concerning the dispute…”
In September 2014, the Government of Ghana dragged Ivory Coast to the International Tribunal of the Law of the Sea (ITLOS) in Hamburg, Germany, after the francophone neighbour began laying claim to some offshore oil concessions and adjoining seabed being developed and exploited by various companies, including Tullow Oil plc, within Ghana’s territory.
Ghana’s resort to ITLOS under the United Nations Convention on the Law of the Sea (UNCLOS) followed 10 failed attempts at negotiations between the two countries. Ghana wants ITLOS to declare that it had not encroached on Ivory Coast’s territorial waters. Ghana filed its suit based on Article 287 Annex VII of the 1982 UNCLOS.
Ivory Coast, in February 2015, filed for preliminary measures urging the tribunal to suspend all activities on the disputed area until the definitive determination of the case, dubbed: “Dispute Concerning Delimitation of the Maritime Boundary between Ghana and Cote d’Ivoire in the Atlantic Ocean.”
Ghana maintained that Ivory Coast began issuing threatening letters to oil companies operating in the disputed area after millions of dollars had been invested to develop the affected oilfields.
Exploration and exploitation work on the Tweneboah-Enyera-Ntoumme (TEN) project being operated by Tullow Oil Plc and its partners would have been affected had the tribunal order a suspension of all activities.
However, in April last year, ITLOS, in its provisional measures, said ongoing projects in the disputed fields, including the $4.9 billion (3.2 billion pound) TEN project could proceed while the substantive case was being dealt with, but ordered that Ghana should not start new explorations within the same fields.
The provisional measures followed legal and technical representations made by both countries at ITLOS’s Special Chamber in Hamburg, Germany, on March 29 and 30, 2015, after which ITLOS ruled thus:
THE SPECIAL CHAMBER,
(1) Unanimously
22 Prescribes, pending the final decision, the following provisional measures under article 290, paragraph 1, of the Convention:
(a) Ghana shall take all necessary steps to ensure that no new drilling either by Ghana or under its control takes place in the disputed area as defined in paragraph 60;
(b) Ghana shall take all necessary steps to prevent information resulting from past, ongoing or future exploration activities conducted by Ghana, or with its authorisation, in the disputed area that is not already in the public domain from being used in any way whatsoever to the detriment of Côte d’Ivoire;
(c) Ghana shall carry out strict and continuous monitoring of all activities undertaken by Ghana or with its authorisation in the disputed area with a view to ensuring the prevention of serious harm to the marine environment;
(d) The Parties shall take all necessary steps to prevent serious harm to the marine environment, including the continental shelf and its superjacent waters, in the disputed area and shall cooperate to that end;
(e) The Parties shall pursue cooperation and refrain from any unilateral action that might lead to aggravating the dispute.
(2) Unanimously
Decides that Ghana and Côte d’Ivoire shall each submit to the Special Chamber the initial report referred to in paragraph 105 not later than 25 May 2015, and authorises the President of the Special Chamber, after that date, to request such information from the Parties as he may consider appropriate.

Decides that each Party shall bear its own costs.

Before ITLOS’s provisional measures, Ivory Coast had, in a 27-page application, signed by its Minister of Petroleum and Energy, Mr Adama Toungara, urged the tribunal to, also direct Ghana to refrain from granting any new permit for oil exploration and exploitation in the disputed area.
It also prayed the tribunal to direct Ghana to refrain from any unilateral action entailing a risk of prejudice to the rights of Ivory Coast and any unilateral action that might lead to aggravating the dispute.
The Ivory Coast argued that it would suffer severe and irreparable economic injury if its request was not granted by the tribunal.
It also accused Ghana of attempting to prejudice the tribunal’s upcoming decision by going into the merit of the case with volumes of documents and witness statements, but Ghana faulted its neighbour for departing from the law, making baseless accusations, being inconsistent and failing to produce witnesses and expert evidence.
Ghana also reminded Ivory Coast of its lack of consistency and merit in filing for preliminary measures.
The absence of credible data and evidence from Ivory Coast, according to Ghana, at the time, was due to that country’s handicap in producing factual documents to back its case.
Ghana, which was led by Attorney-General and Minister of Justice, Mrs Marietta Brew Appiah-Opong, also reminded the tribunal of Ivory Coast’s failure to challenge the evidence of its technical witnesses, which, according to it, tore Ivory Coast’s case in shreds.
“We invite you to firmly decline the application before you,” Mrs Appiah-Opong said, with the argument that Ivory Coast had failed to prove that Ghana had encroached on its territorial waters to warrant the stoppage of activities, including the exploration of oil in the disputed area, until the final determination of the dispute.
“There is no justification in law, logic, and fairness or on the evidence for the measures sought. They will be unprecedented, an invasion of sovereign rights that stand in the face of representations made by Cote d’Ivoire for more than four decades, on which others and we have relied,” she stressed.
Leading a team of local and international lawyers and technical staff from relevant agencies, Mrs. Appiah-Opong told ITLOS’s five-member panel that “until Ghana was well advanced with its oil exploration programme on its side of the boundary, there were no difficulties.
“At the time when Cote d’Ivoire had much more oil and gas production than Ghana, there were no claims about moving the maritime boundary.

In September 2014, the Government of Ghana dragged Ivory Coast to the International Tribunal of the Law of the Sea (ITLOS) in Hamburg, Germany, after the francophone neighbour began laying claim to some offshore oil concessions and adjoining seabed being developed and exploited by various companies, including Tullow Oil plc, within Ghana’s territory.
Ghana’s resort to ITLOS under the United Nations Convention on the Law of the Sea (UNCLOS) followed 10 failed attempts at negotiations between the two countries. Ghana wants ITLOS to declare that it had not encroached on Ivory Coast’s territorial waters. Ghana filed its suit based on Article 287 Annex VII of the 1982 UNCLOS.
Ivory Coast, in February 2015, filed for preliminary measures urging the tribunal to suspend all activities on the disputed area until the definitive determination of the case, dubbed: “Dispute Concerning Delimitation of the Maritime Boundary between Ghana and Cote d’Ivoire in the Atlantic Ocean.”
Ghana maintained that Ivory Coast began issuing threatening letters to oil companies operating in the disputed area after millions of dollars had been invested to develop the affected oilfields.
Exploration and exploitation work on the Tweneboah-Enyera-Ntoumme (TEN) project being operated by Tullow Oil Plc and its partners would have been affected had the tribunal order a suspension of all activities.
However, in April last year, ITLOS, in its provisional measures, said ongoing projects in the disputed fields, including the $4.9 billion (3.2 billion pound) TEN project could proceed while the substantive case was being dealt with, but ordered that Ghana should not start new explorations within the same fields.
The provisional measures followed legal and technical representations made by both countries at ITLOS’s Special Chamber in Hamburg, Germany, on March 29 and 30, 2015, after which ITLOS ruled thus:
THE SPECIAL CHAMBER,
(1) Unanimously
22 Prescribes, pending the final decision, the following provisional measures under article 290, paragraph 1, of the Convention:
(a) Ghana shall take all necessary steps to ensure that no new drilling either by Ghana or under its control takes place in the disputed area as defined in paragraph 60;
(b) Ghana shall take all necessary steps to prevent information resulting from past, ongoing or future exploration activities conducted by Ghana, or with its authorisation, in the disputed area that is not already in the public domain from being used in any way whatsoever to the detriment of Côte d’Ivoire;
(c) Ghana shall carry out strict and continuous monitoring of all activities undertaken by Ghana or with its authorisation in the disputed area with a view to ensuring the prevention of serious harm to the marine environment;
(d) The Parties shall take all necessary steps to prevent serious harm to the marine environment, including the continental shelf and its superjacent waters, in the disputed area and shall cooperate to that end;
(e) The Parties shall pursue cooperation and refrain from any unilateral action that might lead to aggravating the dispute.
(2) Unanimously
Decides that Ghana and Côte d’Ivoire shall each submit to the Special Chamber the initial report referred to in paragraph 105 not later than 25 May 2015, and authorises the President of the Special Chamber, after that date, to request such information from the Parties as he may consider appropriate.

Decides that each Party shall bear its own costs.

Before ITLOS’s provisional measures, Ivory Coast had, in a 27-page application, signed by its Minister of Petroleum and Energy, Mr Adama Toungara, urged the tribunal to, also direct Ghana to refrain from granting any new permit for oil exploration and exploitation in the disputed area.
It also prayed the tribunal to direct Ghana to refrain from any unilateral action entailing a risk of prejudice to the rights of Ivory Coast and any unilateral action that might lead to aggravating the dispute.
The Ivory Coast argued that it would suffer severe and irreparable economic injury if its request was not granted by the tribunal.
It also accused Ghana of attempting to prejudice the tribunal’s upcoming decision by going into the merit of the case with volumes of documents and witness statements, but Ghana faulted its neighbour for departing from the law, making baseless accusations, being inconsistent and failing to produce witnesses and expert evidence.
Ghana also reminded Ivory Coast of its lack of consistency and merit in filing for preliminary measures.
The absence of credible data and evidence from Ivory Coast, according to Ghana, at the time, was due to that country’s handicap in producing factual documents to back its case.
Ghana, which was led by Attorney-General and Minister of Justice, Mrs Marietta Brew Appiah-Opong, also reminded the tribunal of Ivory Coast’s failure to challenge the evidence of its technical witnesses, which, according to it, tore Ivory Coast’s case in shreds.
“We invite you to firmly decline the application before you,” Mrs Appiah-Opong said, with the argument that Ivory Coast had failed to prove that Ghana had encroached on its territorial waters to warrant the stoppage of activities, including the exploration of oil in the disputed area, until the final determination of the dispute.
“There is no justification in law, logic, and fairness or on the evidence for the measures sought. They will be unprecedented, an invasion of sovereign rights that stand in the face of representations made by Cote d’Ivoire for more than four decades, on which others and we have relied,” she stressed.
Leading a team of local and international lawyers and technical staff from relevant agencies, Mrs. Appiah-Opong told ITLOS’s five-member panel that “until Ghana was well advanced with its oil exploration programme on its side of the boundary, there were no difficulties.
“At the time when Cote d’Ivoire had much more oil and gas production than Ghana, there were no claims about moving the maritime boundary.

Saraki, NASS commission at loggerheads •Over appointment of new clerk
Senate President Bukola Saraki and the leadership of the National Assembly Service Commission (NASC) are at loggerheads over the appointment of Mr. Sani Omolori as the acting clerk to the National Assembly (CCNA) and head of the legislative bureaucracy.
The Commission had on Wednesday announced the appointment of Omolori, clerk of the House of Representatives as the clerk to the National Assembly (CCNA).
But Saraki, in a letter endorsed by his chief of staff, Senator Isa Galaudu, asked the NASC to reverse the appointment and name Mr Ben Efeturi, the incumbent deputy clerk to the National Assembly.
The letter stated that due process was not followed in naming Omolori, who is seen as junior to Efeturi in the National Assembly hierarchy.
The letter by Saraki’s chief of staff dated April 21, 2016 and titled “Withdrawal of Letter of Appointment of Acting Clerk of National Assembly,” reads: “We present to you the compliments of the President of the Senate and Chairman of the National Assembly, Dr. Abubakar Bukola Saraki, CON. Please recall that during your last meeting with the Senate President on April 20, 2016, the procedure of the appointment of the acting clerk of the National Assembly was discussed.
“The Commission was directed to follow due process and ensure that seniority is adhered to. Of course, Mr Benedict Efeturi, who is deputy clerk of the National Assembly (DCNA) and who has previously acted as the clerk of the National Assembly should be the first to be considered.
“The President of the Senate and the Speaker of the House of Representatives were informed that Mr. Efeturi was not considered for the appointment because he was not duly appointed as deputy clerk of the National Assembly. On further enquiry, we found he was duly appointed by the National Assembly Service Commission vide extract from minutes of its 403rd meeting held on Friday, 21st November, 2014.
“From the foregoing, you have misled and misinformed the President of the Senate and Speaker of the House of Representatives.

“Please accept the assurances of my warmest regard."

They get closer and closer together and increasingly painful. But Alana is in good spirits and lets everything run its course. She’s even still cracking jokes.
Then, when the birth really sets in, she reaches her limit. But help comes from an unexpected place.
The little Luiza climbed into the pool to help her mother.
She held fast to her mother and gave her strength. She knows that her mom can do it.
Alana conjured up all of her remaining strength. She took a deep breath and then it was time.
The little Benjamin is born. The midwives rejoice with the family. Alana can hardly believe her luck and Luiza is impressed by her strong mom, and by her little brother.
Alana holds her little one proudly in her arms. She’s completely overwhelmed. Her pain is forgotten and now she is simply happy.
The entire family together once again. Luiza can hardly believe that the sweet little bundle is her brother.
After Benjamin has been washed, he is placed back on his mothers stomach – with umbilical cord and placenta. In natural births, these organs have an important symbolic meaning and are first detached later because the still contain a lot of important nutrients for the baby.
Now the big sister may hold her brother in her arms. Wearing the romper suit that she picked out for him. She is sure to be a wonderful big sister.

Politics Goodluck Jonathan Receives Another Two International Awards
Former President Goodluck has received two international awards by the cities of Antioch and Lathrop in California for promoting peace and democracy in Africa.
At the award ceremony held in Antioch, California, on April 23, the mayor of the city of Antioch, Mayor Wade Harper, expressed his admiration for Mr. Jonathan and declared that the city of Antioch, California, was proud of his legacies, especially his act of overseeing free, fair and conclusive elections and leaving the scene when the ovation was loudest.
He recommended Mr. Jonathan’s behaviour to other leaders.
Mr. Jonathan, who was represented by his former aide, Reno Omokri, gave a goodwill message to the two cities that had gathered to honour him as well as to the Nigerian community in the Bay Area of California.
Mr. Jonathan said he was “proud of Nigerians in the diaspora and more so of Nigerians in the US and even more so of the Nigerian diaspora in California.”

With the traditional Adire outfit on a pair of jeans trousers , the youngster whose stage name is T - rapper, not just dazzled the teeming audience , but was also spontaneous in some of his remarks.
After the performance , our correspondent caught up with him and had a brief interview with him. He was also asked to do a freestyle on the spot .
Master Akanbi, who said that he has been rapping since he was six , also called out popular award -winning Nigerian artist, Olamide aka Badoo, stating that he could match the finesse of the ‘street ’ rapper, although his ultimate goal remains having a collabo with the Eyan Mayweather crooner .

Why Is Sexual Temptation A Bigger Problem For Men than For Women?
While women are by no means immune from sexual temptation, men struggle with sexual temptation to a much greater degree. Far more men commit adultery than women. In premarital relationships, men are far more likely to seek sex from their partners than women. This is perhaps hinted at in Matthew 5:28, which refers exclusively to men lusting after women. While lust is sinful for both men and women, the fact that the passage only speaks of men committing “heart adultery” implies that sexual temptation is primarily a male problem.
Why is this? Why is sexual temptation a bigger problem for men than for women? The Bible does not seek to answer this “why” question. Instead, the Bible makes it abundantly clear that sexual immorality is always a sin (Acts 15:20; 1 Corinthians 5:1; 6:13, 18; 10:8; 2 Corinthians 12:21; Galatians 5:19; Ephesians 5:3; Colossians 3:5; 1 Thessalonians 4:3; Jude 7). The fact that overcoming sexual temptation is more difficult for men is definitely not an excuse. “It is so hard to resist” is not an explanation God will accept from a man, or from a woman for that matter. Again, sexual immorality is always a sin. Therefore, sexual temptation is to be overcome (1 Corinthians 6:18), whether the temptation is strong or mild, and whether the person tempted is a man or a woman.
Since the Bible does not specifically give an answer as to why sexual temptation is a greater struggle for men than for women, we can look to biology/physiology for insight. Physiologically, men typically have a much stronger sex drive than women. Men naturally think about sex more often and desire sex more frequently than women do. Especially when sexual intercourse has not occurred recently, the male body has a greater desire for the release that sex provides. This is then compounded by the fact that men are far more easily stimulated by sight than women are (which also explains why men are far more prone to look at pornography). Simply the sight of an attractive female is sometimes enough to trigger a male’s sex drive. If a sexual thought is not immediately forsaken (with God’s help), it can become a cascading river of sexual temptation, very difficult to resist.
Again, let it be said, the male sex drive is a fact, not an excuse. If a man gives in to sexual temptation, he has no one to blame but himself. First Corinthians 10:13 declares, “No temptation has overtaken you that is not common to man. God is faithful, and He will not let you be tempted beyond your ability, but with the temptation He will also provide the way of escape, that you may be able to endure it.” If we do not take advantage of the divinely provided “way of escape,” we are without excuse. Sexual temptation can be powerful, and sexual sin is among the most devastating (1 Corinthians 6:18). But, with God’s help, sexual temptation can be defeated. This is equally true for men and women. I agree with the answer. In addition, men have the propensity to continue to conquer the opposite sex probably in the erroneous effort to confirm the headship given to man by God. In this drive man seeks to sexually subdue as many women as possible in his lifetime.
They are armed with a sexual equipment that is naturally external and so exposed to stimulation by the slightest contact; with a mentality that seeks immediate gratification of these sensations and the power of independence ascribed to men by many cultures of the world, man becomes an easy instrument at the hand of the devil for the perpetration of sexual sins.
Again I am of the view that although God told the woman that “thy desire shall be to thy husband, and he shall rule over thee” God endued women with a special kind of resilience to external and internal influences. That is why they are probably more patient than men in dealing with emotional issues, and they can bear physical pain more that men (the Italian scientist Spiegler proved that the highest threshold of pain on earth is the pain of childbirth).
